This agreement is between Whitney Grace Photography and the Client booking a session


Agreement

Overview: This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to do so in writing, signed by all the Parties.

Session: Client and Photographer are agreeing on the following agreements for the discussed session....

Photographers and clients agree that communication is key in making this the best and enjoyable session possible. 

Change of Location or Time: The Photographer must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of the event. Notification of any changes can be made by phone to the number 8702733773. It is the client's responsibility to confirm all arrangements at least 7 days prior to the event. In the event of a change of location, time, and/or contact information listed, you must notify the Photographer.

The Photographer kindly asks that the Client get in touch with the Photographer two weeks prior to the date of the event in order to touch base and go over last-minute details. The Photographer will make every effort to contact the Client, but it is the Client's responsibility to contact the Photographer to confirm all events and times.

In some cases, the weather is not always predictable. If the weather is predicted in the forecast, the photographer will reach out to the client and offer the soonest reschedule time as possible. The photographer will reach out as soon as she is made aware of the weather forecast and will offer a full refund or a reschedule. 

Force majeure: If the Photographer or its assigns cannot perform this Agreement due to a fire, casualty, strike, or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism, or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, less retainer fee and expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, or lost.

Retainer/Payments: A retainer fee minumum of $100 +tax is required for all the agreed sessions, more may apply to certain packages. This fee is non refundable and will not be given back. 

This is a non-refundable retainer. In the event of cancellation by client, the retainer paid is non-refundable. It shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No date is completely reserved until a retainer is received. The retainer shall be applied towards the total cost of the service to be rendered. The balance of the complete package price must be paid before or on the day of the event. If retainer payment is not received, the Photographer will not be expected to attend said event. In the event that the rest of the payment is not received after the session, the Photographer will not deliver galleries until the payment is sent and received.

Clients understand that when processing their payments, tax is added to the retainer fee and all following payments.

Delivery of Images: Clients understand images/galleries will not be delivered on the day of the session. There is a maximum of a four-week turnaround time for all galleries. Once image is delivered, and clients have printing and sharing rights. All images taken by the photographer are still owned and property of Whitney Grace Photography. Images may or may not be posted on public social media pages. When a client personally shares images, the photographer asks that the photographer be tagged. The client understands that they can not edit or alter the image delivered in any way, including adding filters, removing people, changing colors, etc. If client chooses to avoid contract and edits or alters images in anyway then photographer will reach out legal options. 

Overall: Clients agree to all statements above and the policies listed below that are also posted on my website, Instagram page, and Facebook.

Payments: I do require a NON-REFUNDABLE down payment minimum of $100 when booking a session and the remainder of the price must be paid before the session. All payments will be taxed.

Canceling/rescheduling: When canceling a session I must RECEIVE at least a WEEK'S notice, if less than a week's notice you will not have the OPPORTUNITY to reschedule and I will keep the down payment.

Editing: The client understands and has looked over the photographer's editing style, which includes bold colors, and light Photoshop editing. The photographer does not edit out major issues with clothing, hair, and other bodily features. If the client is unhappy with their images due to the skin color (due to spray tans, dry skin, uneven skin tone), eye color not popping, clothing issues, hair in the face, etc. then the photographer is not responsible. Client must take into perspective of this when choosing their outfits, hair, and makeup. 

Turnaround Time: Turnaround time for sessions is four weeks max for the regular session, weddings have a different contract. To make important client deadlines I offer a $30 quick turnaround time.

Downloading/Sharing: I use pixie set to deliver galleries, from there you can download your gallery to your device. DO NOT SCREENSHOT IMAGES
